This Terms of Use agreement (“Agreement”) is between you and Elite Funding Group LLC (“Elite Funding Group,” “our,” “us,” or “we”) and applies to the website located at www.elitefundinggroup.com (the “Site”), and governs your access to and use of the Site, including any content, functionality, and services offered on or through the Site (collectively, “Services”). The Site is owned, controlled, and operated by Elite Funding Group. The Site is intended for individuals over the age of eighteen (18). If you are under the age of 18 years old, please do not access the Site.

By accessing, browsing, or using the Site, you acknowledge that you understand, accept, and agree to, and are bound by this Agreement and our Privacy Policy, which is incorporated into this Agreement by reference. You agree to the fullest extent required by the applicable laws of any state, that you have provided, have received, and agree to all disclosure and consent requirements. Your use of, or participation in, certain Services may be subject to additional terms; by agreeing to proceed with any such Services you acknowledge that you have read, understand, and agree to be bound by any additional terms displayed or referenced that apply to the Services.

Elite Funding Group is a Florida limited liability company (LLC) with its corporate headquarters located at 9840 S.W 77th Ave Ste 203 Miami, FL 33156.

This Agreement is subject to change by Elite Funding Group in its sole discretion at any time without notice. Such revisions become effective immediately upon posting on this Site. The most current version of this Agreement will be available to you by clicking the link at the bottom of the Site. Your continued use of this Site and/or Services constitutes your acceptance and agreement of such revisions. Compliance with this Agreement grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

Defined Terms

For purposes of this Agreement, “you” or “your” means the person(s) using this Site and/or Services, and any person(s) for whom such person(s) are acting as an agent with respect to this Site and/or Services.

Third parties include, but may not be limited to, lenders, service providers, and other entities offering products and services through this Site.

Use of the Site and Services

As a user of the Site or a user registered to use any of the Services (a “Registered User”), you agree to the following:

1. Exclusive Use. Your account is to be used only by you and only for your business needs. You may not authorize others to use your account on your behalf, and you may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Elite Funding Group is not responsible for third-party access to your account that results from theft or misappropriation of your username(s) and password(s).

You are solely responsible for and assume all liability regarding: (i) the information and content you provide through your use of the Site and any Services; (ii) the information and content you make available in any manner through the Site or any Services; and (iii) your interaction with all third parties.
3. Risk Assumption and Precautions. You assume risk when using the Site and Services.
4. No Guarantees. Elite Funding Group makes no guarantee as to any outcome using the Site or Services.
5. No False Information. You will provide accurate, true, current, and complete information.
6. Legal Purpose. You will only use the Site or Services in accordance with applicable federal, state, and local laws.
7. Business Purpose. You will only use the Site or Services for bona fide business purposes. You will not use the Site or Services for personal, family or household purposes. You will not use the Site or Services to obtain information about or make decisions about anyone but yourself and/or your business.
8. Age. By using or accessing the Site, you acknowledge you are at least 18 years of age.
9. Errors and Delays. We are not responsible for any errors or delays in responding to a request or referral form caused by incorrect information provided by you or any other technical problems beyond our reasonable control.

Intellectual Property

1. Ownership of Proprietary Information. You hereby acknowledge and agree that Elite Funding Group is the owner or licensee of all rights in and to the Site and Services, including, by way of example and not by way of limitation, names, logos, patents, videos, images, and designs. All trademarks, service marks, trade names, trade dress, and related intellectual property rights in the Site and/or Services are proprietary to Elite Funding Group or our licensors or licensees and these proprietary rights are protected by federal, state, and local laws and regulations. The Site and its entire contents, features, and functionality (including, but not limited to, all web pages, user interfaces, information, design, software, source code, displays, graphics, images, videos, audio recordings, and the design, selection, and arrangement thereof), are owned, controlled, or licensed by Elite Funding Group. You are permitted to use the Site and Services only as expressly authorized by this Agreement. You may not copy, display, reproduce, distribute, or create derivative works, reverse engineer, or reverse compile any of the Site or Services or technology.
2. No Use of Proprietary Information. You will not duplicate, publish, copy, modify, participate in the transfer of, create any derivative works from, post on the world wide web, distribute, display, reproduce, or in any way distribute or exploit the Site, or any portion of the Site, for any public or commercial use without the express written consent of Elite Funding Group. You also agree that you will not (i) remove or alter any trademark or other proprietary notice, or legend displayed on the Site (or printed pages produced from the Site); and (ii) make any other modifications to any documents obtained from the Site other than in connection with completing information required to transact business with Elite Funding Group.
3. License to Provided Content. By providing information or content to any account or public area of the Site or Services, you automatically grant, and you represent and warrant that you have the right to grant, to Elite Funding Group, an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, reproduce, publicly perform, publicly display and distribute such information and content, and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sub-licenses of the foregoing. From time to time, we may create, test, or implement new features or services on the Site in which you may voluntarily choose to participate, in accordance with the additional terms and conditions of such features or programs. By your voluntary participation in such features or programs, you grant us the rights stated in this subsection in connection with the additional terms and conditions (if any) of such features or programs.

Prohibited Conduct

You agree not to engage in any of the following activities:

1. Violating laws, third party rights, and/or this Agreement;
2. Using any data mining, robots, or similar data gathering and extraction methods;
3. Interfering with security-related features of the Site or Services, including without limitation, accessing any service or content on the Site or Services through any technology or means other than through the Site or Services themselves;
4. Interfering with, disrupting, or creating an undue burden on the Site or Services or the networks or services connected to the Site or Services;
5. Posting, transmitting, promoting, or distributing any illegal or unauthorized material or information, including material that is defamatory, obscene, threatening, harassing, abusive, or that could constitute or encourage a criminal offense, violate the rights of any party or otherwise give rise to liability, or violate any law; and
6. Using the Site or Services to send unsolicited communications or for any other unlawful purpose.

User Information

Elite Funding Group’s Privacy Policy governs the collection and use of user information. You agree to Elite Funding Group’s Privacy Policy.

Auto-Dialed Calls

By providing your telephone number to Elite Funding Group, you consent to receive telephone calls or SMS/text messages, including through the use of automated technology, artificial voice, and prerecorded messages, at that number. You consent to receive calls and SMS/text messages for purposes of completing the services you have requested, fulfilling the legitimate purpose for which the information was submitted, or for other purposes related to your account. You understand and agree that Elite Funding Group may use the telephone number you provide even if that number is registered to a cellular telephone service or otherwise on a “Do Not Call” list. You understand and agree that you are not required to agree to the receipt of such calls or messages as a condition of receiving any services from Elite Funding Group.

Links to Third-Party Websites

Elite Funding Group’s Site may contain links to third-party websites. These links are provided solely as a convenience to you and not as an endorsement by Elite Funding Group of the contents of such third-party websites. Elite Funding Group is not responsible for the content of linked third-party websites and does not make any representations regarding the content or accuracy of materials on such third-party websites. If you decide to access linked third-party websites, you do so at your own risk and in accordance with the terms and conditions of use for such third-party websites.

Disclaimer of Warranty

Elite Funding Group’s Site and Services are provided “as is” and without warranties of any kind, whether express or implied. To the fullest extent permissible under applicable law, Elite Funding Group disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Limitation of Liability

Under no circumstances will Elite Funding Group be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of or inability to access or use the Site or Services, whether or not the damages were foreseeable and whether or not Elite Funding Group was advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold Elite Funding Group harmless from and against any and all claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of the Site or Services and/or your breach of any representation, warranty, or other provision of this Agreement.

Email Communications

By providing Elite Funding Group with your email address, you consent to receive electronic communications from Elite Funding Group. These communications may include notices about your account and information concerning or related to the Site or Services. These communications are part of your relationship with Elite Funding Group and you receive them as part of your use of the Site or Services.

Text/SMS Messages

By providing Elite Funding Group with your telephone number, you consent to receive text messages from Elite Funding Group. You may opt out of receiving such messages at any time by following the instructions provided in the message.

Mobile (SMS) Terms of Service

Elite Funding Group LLC (“EFG”) offers SMS text messaging services to provide alerts, marketing messages, application reminders, and abandoned application/cart notifications. By opting-in to receive SMS communications, you consent to receiving automated SMS messages from Elite Funding Group via Klaviyo, including but not limited to promotional messages, service notifications, account alerts, and abandoned cart reminders.

Message frequency may vary based on your interaction and application status. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opting Out You can opt out of receiving SMS messages at any time by replying STOP to any SMS message sent from Elite Funding Group. You will receive a confirmation message confirming your opt-out.

Suspension of Services

Elite Funding Group may suspend, restrict, or terminate your access to all or any part of the Site or Services at any time for any reason without prior notice or liability.

Termination

Elite Funding Group may terminate this Agreement at any time for any reason. You may terminate this Agreement by ceasing to use the Site or Services.

General Provisions

This Agreement is governed by the laws of the State of Florida without regard to its conflict of law provisions. Any action or proceeding arising from or relating to this Agreement must be brought exclusively in a federal or state court in the State of Florida, and you irrevocably submit to the exclusive jurisdiction and venue of any such court in any such action or proceeding.

Severability

If any provision of this Agreement is determined to be unlawful, void, or unenforceable, the remaining provisions of this Agreement will continue to be fully valid, binding, and enforceable.

Entire Agreement

This Agreement and our Privacy Policy constitute the entire agreement between you and Elite Funding Group regarding the use of the Site and Services, superseding any prior or contemporaneous understandings, agreements, or communications between you and Elite Funding Group.
